can my husband &i submit i130,i485 first then i693?

Hi

So since I am out of status right now, I'd like to get the petition submit as soon as possible. I am still working on getting my medical exam. Can I submit i693 later?


Another question is about i-g325a, I know that I need to fill it out, does my husband (the us citizen) need to fill one out as well? If so, under the section "this form is submitted in connection with an application for" should we both fill "status as Permanent Resident"?

According to the I-693 page, it can be filed with the I-485 or later. However, many people suggest to file them together, because getting an RFE may delay your case.

Follow the form instructions. For the I-130, you and your husband have to each fill out a G-325A. For the I-485, you need to fill out a G-325A. So there needs to be three G-325As total. For the ones for the I-130, you can check "Other" and write "I-130". For the one for the I-485, you can check "status as Permanent Resident". Ultimately what you put there doesn't matter, as long as they know what form it's form.

Ohhhh, thanks for the info about that 3 G-325A forms. I heard that my husband and I would both need one but didn't know I'd need 2.

The only reason I am asking if I could send them separately is that I try to avoid "illegal stay" (though I am not sure in what situation is it illegal stay). I think that when the petition is received, I would be authorized to stay. I now understand that I am out of status, but because of the grace period, I am still authorized to be here until the end of this month. And we got stuck on getting an appointment with a civil surgeon so I am worried that this may delay us from submitting the petition in time and ultimately it will hurt the case because of "illegal stay".

Also I understand that getting RFE will delay the case, but what if I can just submit the I-693 before they even send me an RFE? say just a week or two after I sent i-485?

It's true. They won't deport you once your AOS is pending. It's highly unlikely they will find and deport you in any case.

Send I-130 and I-485 together. Separate them into different parts of the package. I-864 and I-693 and your G-325A (and your birth certificate, and two photos) are supporting docs for the I-485. The G-325A for each of you, photo for each of you, evidence of his citizenship, marriage certificate, evidence of bona fide marriage, etc. are supporting docs for the I-130. I-765 and I-131 need to be filed with or after the I-485 so should not be filed separate from the I-485.
