can my husband file for my mother although i was denied?.my next interview is june 2008.how long will it take if my husband file for my mother.please help ,me i need my mom to be beside m

Only you as a U.S. citizen can apply for your mother.
 
Did you ever make your infopass? I still think 1 year between the initial and secondary interview must be a mistake! :p

i totally agree with praetorian, one year gap b/4 the stokes interview is very unusuall, I would schedule for an info pass and get to know where you really stand.
For the first question the answer is No. But u're husband can invite u're mom to vist u guys in the US with a visitors visa, and then go back home till you become a citizen u'reself, then u can file for her.

We've now heard about a few cases where the date for the second interview is scheduled 1-2 years after the first one. The immigration process is constantly changing and it appears that this incidence will become a norm.

Based on what I've read and been told, it seems as if the agent schedules second the interview date based on what he/she feels about the legitimacy of the marriage. The longer it is, the less they believe it is legitimate. It makes sense though. The huge delay will most definitely have an impact on marriages that are not legitimate. Hopefully no undeserving couple will have this experience.

I guess whoever falls into this boat, has to be very prepared for what I assume will be a very, very pains taking second interview.
 
Makes no sense to schedule under such thesis. I mean, the people who engage on a fraudulent marriage and get married and fail the first interview get 1 year of working on EAD and traveling on AP? It would be better to Stoke them until they crack. :p ASAP. and get them in jail or deported. :rolleyes:
 
i had a friend did her interview first and was denied.then the second interview was schedule a year after. thats why i cancel my infopass i will wait i have 10 more months to go not in no rush.good things come to those who wait.

Well whatever the thesis is, USCIS has some reasoning. I was just putting in my 2 cents based on the fact that people do get second interview dates 1-2 years after the first. Don't be so hasty to punish, people fall in love and get married after a couple of months (even weeks) of knowing each other. Considering that the processing times for GC applications has improved tremendously- chances are they can have really bad first interview- so maybe it's more time to help them build and prove their own cases (with EAD/AP privileges) . Who knows???

oh i just found out that the average waiting for a stoke interview is one year, so u are still on track, just be patience you will be fine.

You were denied because the IO was not convinced that you had proved beyond a reasonable doubt that your marriage was bona fide. At this point the IO had 2 options:
1. Deny completely and subject you to deportation or
2. Give you a change to prove that it is indeed bona fide, hence the second interview.

The IO chose Option 2, gave you enough time to build up enough supporting documentation and gave you the opportunity to know your spouse much much better. I would use the time to do just that.

By the time you get to the next interview, you should know your spouse better than his/her own mother and have enough documentation to give the IO no other choice but to approve.

It is also a way to test to see whether you will be together at that time. Look on the bright side, if you get approved at the second interview you qualify for a 10 year GC assuming you were married for less than 2 years as at the time of your first interview.

yes i think the io is giving me more time to get things together.because when we went we only took bank letter couple pictures and io said if we have any more i said no he said why and i tell him we don't like taking pictures.but majority of the time the genuine marriage is the one that always suffer and the fake ones always get approved just a comment.me and my husband talking for six years now.almost seven thats a genuine relationship i will wait for my next interview if its even 3 years time i'll wait to show its a bonafide marriage.
