can my gf/fiancee come to US with her B1 visa and we get married here?

my fiancee has a B1 visa and visited US before for business. can she come to US with her B1 visa and we get married here? is there any problem at the custom if that is the purpose of her trip? btw, I am on H1B. thanks for your help and advice.

Well... I dont think it would be a problem. You are on a H1B visa, which is a non-immigrant visa.... she will marry a non-immigrant visa holder, which is different of marrying a USC or GC holder....so her intends are not to immigrate to the U.S.

HOWEVER... the IO would be questioning her why you guys dont marry in your country....if she is coming to the US with a B visa her main purpose can not be marrying... B1/B2 is for tourism or business...

NOW... you are in a H1B visa... if you marry her and want her to stay here with you, I guess you will have to file for a depended of H (I am not sure if that is possible), or wait until you get your GC... but the wife of a GC holder takes about 5 years to get a GC...

thanks for your reply. my gf actually is planning to visit me. we are wondering if she mentions that she comes here to visit her bf, would that be a problem with her b1 visa? can she get 6 months on her i-94?

as of change of status if we get married here, is that a problem from b1 to h4, as one is short term intention, the other is long term. any risk to get rejected? any problem if later we go back to home country and apply h4 visa there?
