Can my brother-in-law avail 5 points for sister's PR status in Canada

I am permanent Resident of Canada since June 2003 but not staying in Canada. I don't have any intention to move to Canada atleast for next two years.

My brother-in-law want to apply for his PR in Canada.

What are the ways, he can avail 5 points to be eleigible for applying for PR.

He can't, his family ties have to be with someone living in Canada, not with someone who doesn't.
 
Your Brorther-in-law will get 5 points.

I am landed Immigrant of Canada, but staying in USA. I applied for my brother last year through lawyer. Lawyer said, my brother will get 5 points (family member in Canada).

You got your PR Card ? If yes, then you will have your 'Canada Address'. That works. Even in my case, I had no PR card at that time when I applied for my brother. Only landing stamp in my passport was there. I gave photocopy of that to lawyer. And Lawyer submitted that photocopy along with my brother's application.

Was your BIL successful in getting his PR? I wanted to find how much time it takes since I would like to do the same. Also, would you recommend your lawyer? What about his fees? It would be good if you can publish his contact info. Thanks a bunch.
 
I think lawyer not required.

Well, my brother is staying in India and I am/was in USA. So, while applying for him, I thought lawyer can prepare better docuementation. And based on proper documentation you will not miss anything and you are reducing the chances of rejection.

One more reason to hire lawyer was that. In India it takes 36 months for whole process. But we can apply from other country also. Lawyer told me, we can apply from Brazil or some other country, where things are faster. So, I was not aware of that, how to apply from foreign countries. so, I hired lawyer. And at last lawyer applied from Singapore, which is not really faster, may be bit faster than India.

Now, I heard that Manitoba PNP is faster. 9 months or so. Peole advertise such thing in India conferrence about Canada immigration.

When I applied, I did it by myself. But for my brother I hired lawyer. Infact, that firm lady is not lwayer. Any Tom, Dick and Harry can apply for you. It is not necessary to have lawyer degree to apply behalf of some one. Only thing person(Tom, dick) should be knowledgable. Lawyer charges from $1000 to $2000 US dollar.

By the way, on this portal, people can guide you and give answers, if you want to do it by your own.

Well, my brother applid 1 year back. No interview or medical papers received. It takes time. From India 3 years, USA 2 years. Manitoba PNP, no idea, it is faster.

I require some info regarding choosing a lawyer. I am trying to apply for brother's PR for canada. I haven't received my PR yet, just waiting for the interview.

My brother is in India and I want to seek the help of a lawyer for filing my brother's PR. Based on your experience could you advice me where I can get info on some of the best lawyers (or) would you suggest someone who is competent and fair enough to successfully finish this process?

Better you search good lawyer in India.

Well, the firm I choosed is located in Canada. But I am not really happy to deal with them, they never respond properly. They are lack of sincerity and punctuality. I hate that. Specially when you are paying money, they should respond properly. I can suggest that name, because I will get some money. But I dont want to abuse your opportunity by telling you such bullshit name.

If your brother is staying in big cities in India, In newspaper they(lawyer or such people) give advetisment on timely basis for conferrence arrangement. Try to attend that. And find out people in India, who applied through good lawyer and getting proper repsonse.

I will suggest you, better do it by yourself. When you are already aware of that process.

Is your brother falls under one of the following category:

brothers, sisters, nephews, nieces or grandchildren who are orphans; under the age of 18 and not married or in a common-law relationship;

or

you may also sponsor one relative of any age if you do not have an aunt, uncle or family member from the list above who you could sponsor or who is already a Canadian citizen, Indian or permanent resident.

Since my brother-in-law is 28 years old, I am not sure whether I can sponsor him.

Secondly, I understand the place where you can file your application is controlled by the place of your stay. e.g. If you are in US, it is Buffallo.
If you are in India, New Delhi and if you are in UAE--it is UK.

However, you say that we can file from anywhere in the world. (Does it include US for the person working in UAE?)

You can apply for your BIL

My brother was definately 20+. He was/is in India. Working in India only. He never crossed India's border ever.

Yes you can sponser your BIL. I mean your spouse will apply for him. Beause he is your spouse's brother.

Well, my lawyer applied for my brother from outside India, means it should be possible. But it was 1 year back. Now, if rule has got changed, then I dont know.

If you are applying for your BIL from USA, I think you can. But, when interview will be arranged, how your BIL will get visa of USA to attend Canada PR interview ?? Canadian authority is not responsible to arrange USA visa for your BIL to attend interview.

Another thing, For example, if you apply for QUEBEC province, there is no office in India, you have to send/apply in Damascus office of Syria.
