Can it go through EB1-EA, please comment.

Hi guys,

Can some expert suggest if I can qualify for EB1 EA category. My NIW I140 was approved in just 15 days (TSC) in 9/05 and now is stuck in retrogression. I am thinking to file I 140 in EB1-EA and if approved retain NIW 9/05 PD.

My Qualification:

PhD in Virology from Indian University.
Gold medal and a award for best PhD thesis
2 fellowships in MS and PhD
1 University merit scholarship in BS
1 International public health fellowshisp
8 first authored research papers
6 coauthored research papers
1 co-authored research paper in Science
Total 15 citations of my research papers
5 conference presentations
1 invited talk
Membership in 4 professional societies
Developed bird flu vaccine for human use in US govt agency dept HHS
Present job: Visiting Scientist in a US govt working in bird flu research area
Supervised 3 MS students in India
4 years experience as a scientist in India
10 strong recommentation letter from US, Australia,Japan,India, UK, US govt agencies, and universities.
4 years research experience in US

It surprises me that you have only 15 citations from 14 papers?
 
Hi arydk,
I might have got more citations , I need to check in science citation index. I was not having access to citation index web site, and in hurry, I goolgled my name and 15 papers came up with my research citation, I just copied those papers and submitted with my NIW. I filed my NIW my self. Because of retrogression coming in, I somehow deposited pakage to TSC in 9/05. But this time I will search citation index and have the correct total number.

Thanks , I will add citation from Science citation index now for EB1 EA.

I strongly feely you can go ahead for EB1, sometimes citations for a rcently published paper comes out very late, may be u can explain this in your application.
You said you have applied for NIW, what happened to that?
 
My NIW (concurrent) was approved in 15 days of submission in 9/05. Now I 485 is pending. I am working on EAD.

I am in similar situation, my EB2-NIW got approved in 15-20 days (@NSC). I am also thinking of submitting my casse for EB1-EA. I am planning for self filing this time as my attorney is asking another $4000 (same amount he charged earlier for filing NIW). Could you or someone in this forum please help me what all forms & documents we need to prepare for filing this case.

My credentials are:
PhD - Neuroscience (INDIA) + 5 yr Postdoc experience (US)
24 research article (21 first author) - all in international journal having impact facor 2-10)
>350 citations
12 conf abstract + 5 invited speaker
1 US patent (granted to my PI) from my work

EB2-NIW : RD 2/28/06 @NSC, AD 3/12/06

I am also same like you. NIW approved in Jan 06, thinking of applying for EB1 Ea, as the EB2 may take years (looks like). I too would like to know the way to apply for the EB1 Ea self petition, my attorney also asking the same amount as the NIW.\
Any help is appreciated.
 
I have got a question about citation. I have more than 15 papers published on non-English journals and some of these papers have been intensively cited in my home country journals. Would these citations help, or only those cited by papers in international journals?

Hi good_y and vasur72,

You need only form I-140 for filing EB1-EA. I did it online and then submitted the receipt and all the evidence through mail. You have to write a very strong cover letter (3-4 pages) and mention all your accomplishments and about your research. You have to arrange all the evidence in order (appendix I, II, III, etc.) and write about all these evidences in your cover letter citing each appendix. e.g. if you have a patent, you may write I have developed this technique which was patented-----(see appendix #) and so on. Highlight the importance of your work and show that it is going to have great impact on the development of mankind.

My NIW was submitted to VSC, so now do I have to submit it to the same center or to NSC.

I don't think that they should be in any order. But you can have it like this:

1. Application form or receipt if you apply online
2. Cover letter
3. Appendix I (Resume and Degree certificates). Print this out on one page with bigger fonts and then after this page place the copies of your degree certificates.
4. Appendix II (Awards and fellowships). Again print this and place all your documents after this page.
5. Appendix III (Recommendation letters). Do same thing as above.
6. Appendix IV (Articles reviewed, if any).
7. Appendix V (Memberships).
8. Appendix VI (Publications).
9. Appendix VII (Citations). and so on...

Hi arydk,

I checked my citation today and it has come to 61 (sixty one). I did not yet file EB1 EA because I am still in the process of getting the reco letters.
