I am currently on a cap-exempt H-1B visa with a University for about one and a half years now. I have another job offer for a consulting job and have already gotten my H-1B approved in premium processing, effective Oct. 1, 2007. I was considering leaving my current University job by September 30, 2007 and switching to the consulting job then after.
The twist now begins! I have another job offer with a direct employer and I am willing to go to this full-time job to avoid traveling associated with consulting job. My question is, how can I transfer visa? As of right now, my University H-1B is in effect, but my latest approval is for that consulting job effective from Oct. 2007!
By the way, I was trying to get an advantage of new rule as mentioned by MurthyDotCom at http://murthy.com/mb_pdf/060107_P.html topic 3 that I can start working for the cap-subject H-1B visa jobs right away due to portability advantage. I do not know what my options now are. My bottom line wish at present is to start working for the direct full-time job right away, but can I do that?
