Hello,
I got my citizenship few months ago, and am planning to go to India to marry my girlfriend. I plan to stay there and apply for her through spouse visa.
Can I file my papers while I am in India?
When the petition is in process can I stay in India?
Do you know if the process is longer if filling outside of USA?

I looked up the documents needing to be mailed out, it seems like too much. Should I hire a lawyer in India to all this for me?

Please let me know anything you know about Spouse Visa

If you are going to get married in India, it maybe quicker for you to apply there itself. I know of someone who filed the application in India and the spouse got the visa in less than 5 months, last May. I think you may also need to live with your spouse for a few months according to the new rule (don't quote me on it), so you might get it done quicker applying there as you will have to wait till you come back to apply from here. I don't know if the documents that need to be filled out are too much. USCIS gives you all the instructions you need as long as you are ready to take the time to read and understand them. I know a lot of people on here who did it by themselves, just like my wife and I (I was already here), instead of getting a lawyer. If you are willing to take sometime and read through all the forms and do what needs to be done, you can save a lot of $$$, which could be used on your honeymoon :D. If in doubt, you can always post on this forum and someone is sure to reply you.
 
About a month (or a little less) back someone shared a new memo/notice by USCIS that laid out new requirements for filing in a foriegn country. I don't remember the text of the notice but they have made it harder to file in the foreign country by putting up stringent conditions. You might want to look up for that memo to make sure that you will be able to meet those conditions while in India.

I was under the assumption that it only takes 2months, no longer. Since it will take longer (as posted), could I just stay there for a month and come back here, and then file those paper here?

I am really lost, and I appreciate all of your thoughts,and opinions.
