Can i work in India for employer before H1 start date?

Hi all,

My OPT expires on May 19th,and I am currently working for an employer who has already got me an H1B visa starting Oct 2005 for fY06. We did this as a back up ,hoping that the additional 20,000 visas for FY05 would be issued soon,thus allowing me to continue my work. However,May 19th is near and there is no sign of these addtional visas. Does anyone here know if I can go to India from say May 20th to Oct 1st and legally carry on working there, with my salary etc being the same as before?i could then get my visa stamped in Mumbai and come back and continue working. I am sure many of us here have this same issue(OPT expiring before H1 can start) and am wondering if anyone knows any other work arounds.

Without legal permission (through H1B or similar status), you are prohibited from working in the USA ONLY. If you are a citizen of India, and you go back to India, there really is nothing stopping any company from hiring you and paying you.
