Can i work if H1->H4->H1 applied Urgent help needed

Hi all:

Here is my situation:

Came on H1 in mar 2000 did job for 1 year.
Applied for H4 in july 2002 and passport got stamped when i return from india.
Now i applied for h1 b (not approved till), i got the job.
Can i work legally or need to wait for the approval?
I do not want to loose the job if it is not risky.

Your suggetions are appreciated ASAP.

Even if your H1 gets approved you cannot work before Oct 1st as your new H1 will have a start date of Oct 1st.

I may be wrong, check with someone or wait for others to reply.

u need to wait for approval, as you can work with pending application if the prev status allowed you to work. Since you were on H4 that cannot happen.

Now you were counted into H1 in the last six years yiu do not fall under quota. If you are in a hurry then why not spend $1000 to go for premium processing.
