Can I work as an agent on EAD status

Hi,

I currently have an EAD card but I did not update my HR people yet,so technically I am still on H-1.

Now I found a part time job for an additional income and they are asking me to fill up a W-9 form, which is supposed to be filled by US person(including a U.S resident alien).

So because of this reason, I am thinking of updating my HR with my EAD and take up this part time job.

So I wanted to check to see if I am doing right by signing this W9 form because of which I will be getting a second pay check from next month and also will swtich to EAD at my current employer right away.

Any comments or concerns are greatly appreciated???

So once I update myself to an EAD, can I call myself an US resident alien.

Because the W-9 tells me that I should be a US Person or a U.S resident alien.

Pretty much, for the duration of your adjustee status you have the same legal standing for most situations as a permanent resident.

Working on your EAD has no restrictions what so ever and you can hold on to as many jobs as you can manage.

BUT....

If there is an RFE, you need to show u r working in a similar/same job description that u mentioned in ur LCA!!!! So, that would be false!!!

This will be his second job, he still has his primary job, so he can work as long as his EAD is valid.
 
No you cannot represent yourself as a Resident Alien. You can represent your self has Adjustment candidate Employment Authorized. Even Approval Notice of 485 will not be valid enough unitl you obtain I- 551 stamping in your passport.
 
Follow what 140_takes_4ever and RM_CSC have mentioned. You should not have any issues as long as you've a primary job which was mentioned in your LC and can prove it in case you get an RFE.
Yes you're right about informing your current employer so that they can have you fill out W-9.
