Can I Use My Earlier I 140 Approval , Priority Date.

Hi

I have MY earlier priority date is OCT 98 EB-3 and I 140 approved on APR 2000.

I moved to new job and file LABOUR AND I 140 APPROVED AND priority date is JAN 2000 (EB-2). My earlier company gives the I 140 COPY and released to me for my use.

Can I use the earlier priority date and do I have any advantage.

You can use the priority date from your old employer as long as you have a copy of the approved I-140. I did the same way without any problems. I was able to get the priority date from my first job for the new job and am right now waiting for my finger prints notice.

Yes, you should be able to under the I-140 substitution provision. Speak to a good lawyer about it.
