Can i use K-3 now?

Hello,

I'm a US Citizen who got married last week with a non citizen, she got here as a Visitor and we never filled for a Fiance visa, what do i need to do to get her to stay here legally and be able to work and all that, what is the best way to go, every way i go it says to fole a I-130, I will file that when we get our marriage certificate back from the county clerk, what i would like to know is what to do AFTER that has been filed? I live in Los Angeles. Please help.

Hello,

There is no need of K-1/K-3 visa now. All you need to do is, to file the Adjustment of Status application together with the application for Employment Authorization and the Advance Parole.

The forms to be used will be:
I-130
I-485
I-765
I-131
I-864
G-325A(for each of you)

You better hire an attorney if you find it difficult to file them. It is always a safer option, you may wish to contact an attorney from visapro.com.
If you have married her within the period of 30 or 60 days of her entering in the US on visitor visa, then surely hire an attorney who can tell you what to do to avaoid any possible deporation.
