Can I use Experienced acquired with same employer for Perm

Hi,
I was working for a company and laid off in 2003 after working 3 years and now I joined back the same company. My job is pretty much same what I was doing before. I know that in Perm you cannot use the experience which you acquired from same company as to fulfil the qualification. My job requirement says BS + 4 year experience. Does any body know for fact that can I use the experience of 3 years which I got during working here or I cannot. Does anybody has any official link which talks about this issue.

Talk to the attorney. That is why they are hired for.
If the job is the same, you can not use it. If it is around 50+% different than you can use it (but need a good explaination). If you don't shot for EB2 (BS+4 can not do for EB2), why you need to worry about those exp. ?
 
My question was that even I was quit the job and joined again after two year cant I still not use the experience since this time when I joined the company I already had the experience. The reason I want to use that experience that I want to publish the job advertisement with 4 year of experience which is actual requirement of this job. So that there should be less resume submit against the ad.
