Can i Travel while H1B Extension is Pending

Dear All,
My current H1B is valid till February 2007 and i have applied for Extension for another 3 years. I also have valid stamp in my passport for H1B.
Here is my question:-

Can i travel outside U.S. anytime before February 2007 in case the H1B Extension is not approved yet?

If the H1B Extension gets approved while i am outside of the country, can i still come back safely on old H1B before February 2007?

Please assist

How can you reenter after your current H-1B ends if you do not have a new valid one?

If i get it approved in let's say next 1 month, can i immediately go for stamping of new Visa. I still have the old visa stamp valid till Feb 2007?

Current Service policy does not preclude an alien from traveling outside of the United States while a request for an extension of temporary stay is pending with the Service.

Why should yellowrocks be scared by that UN guy? The INS policy does not affect the EOS but the COS only. It has been well known by the immigration community. Don’t you think that UN guy’s posting just proves he is a very young chicken again?

Priority Date Portability and AC-21

DEAR UnitedNations

I have a Labor with priority date of 2004. I also filed I-140 which was approved and I-485 which is pending due to retrogression. This was in EB3.


If i file the labor again with same employer in EB2, will i be able to use EB3 priority date on this new I-140 application? If yes, what is the procedure?

Can i change my employer and file new labor and I-140 in EB2 and retain the priority date of earlier application in 2004?

Do we have to show same or different job duties? which one applies?

Do we have to ammend I 485? If yes how?
