I am on my 7th year extention on H1b and I need to travel to Canada for my PR landing and come back in few days (less than 30 days). My H1b status was extended in 2005 and I got new I-797 , but I dont have new visa stamp in my passport, it expired in May 2005
Please let me know that whether Automatic Visa Revalidation rule still applies. If I travel to canada and come back in less than 30 days, will I be able to come back on valid 94 card (the one that came attached to the new H1b) or I will have to get visa stamping in any US consulate in Canada.
Please note that I already have an appoinment in US consulate in Canada for April first week. Assuming the above rule still applies, does applying (not attending) for an appointment disqualify me from being eligible for Automatic Visa Revalidation.
