All Immigration gurus,

currently I am in India on vacation, My VISA (stamped on passport) has expired when I was in US. I do have H1 extension valid until Aug 2006. I was planning to get VISA stamped while in India. Now I am planning to use Advance parole which I had applied before leaving for India, I have asked one of my friends to send me advance parole by FedEx as soon it comes in mail.

can I travel on advance parole ? I have already got my EAD.

please let me know
thanks,

You can definitely travel using Advance parole and you will not have any problem. You will not loss your H1 status also.
So, if are not getting H1 extension, travel on AP. You will not have any problem.

catch-22

YOu should be in possession of AP before leaving US. If the officer finds it out at POE then there is trouble. Please check before traveling on AP if it was not in your hand before leaving US. POE officer can cross check the dates and deny entry. This has been discussed thorougly elsewhere on the forum.

Travelled outside US (to India) w/o AP , EAD was approved 12/17

Guys, Thanks for the replies ..

I am in tough spot. I am not getting any earlier appointment for stamping my VISA in india. don't know what to do. how big is the risk of travelling on AP ?
