can i transfer my i-140 before 180 days

I am in a bad situation now a days

I am on h1b1 visa and my employer filed my i-140 and 485 together in july 5 2006 ....

both are pending now .....my employer terminate me from the job 2 weeks ago ....i have my valid EAD still avialble with me and my h1b1 is process of transfering to some other company

My question is .... is this possible that i can transfer my i140 and 485 to some other company using portability process AC21 after 180 days ....Note my both petitions are not approved yet ....

should i transfer my h1b1 visa to company A and i140 and 485 to company B

kind let me know the possibilites

Porting I-485 with I-140 unapproved

Its 6 month now since you filed concurrently so you can port your case. However USCIS will evaluate if your I-140 was approvable at the time when you're porting your case. Means that you have to be in good relations with your previous employer because you may need documents like taxes filed and quarterly withholding forms etc from him.
