Can I take independent contracts ...on EAD..experts please help

Hello experts,

I am currently working with my GC sponsoring Company on EAD status. Meanwhile I keep getting small contractual work offers (hourl basis) from other companies. Uptil now I have been rejecting al these side offers.

Can I take such contractual offers and accept check payments??

If so, how am I going to account these extra incomes for my taxes - are these companies supposed to provide me with 1099?

For all these contractual offers I am going to be putting in extra hours (week-nights/weekends) - while I would still be putting my regular office work hours towards my current job.

Please suggest as to how to approach? With the way things are happening at VSC it seems I might not get my GC ever - and I intend to make some extra money - owing to my tight financial situation with my current job.

I would also like to know and do we need to work on EAD with our current GC Sponsoring employee. I am working on H1 and can I take part time(hourly contractual ) job using EAD with another company. They will give me 1099 for that payment.

Pls. help I am also badly in need of that extra cash.
 
Yes - if you have an EAD then you can work in any job with any form of renumeration. For contract work, your 'employer' is required to give you a 1099 detailing the money paid to you.

However (to jazzyb) working on EAD will invalidate your H1. Therefore, if you take this route you must submit a new I9 to your main employer listing your EAD as your authority to work. Of course, you then lose the ability to fall back to H1 if your I485 is denied.

So in addition to working for my regular employer, I can also undertake other contracts and earn extra money as long as I get 1099. Is there any specific article that would re-assure this - as once I do it - there is no going back - and I do not wan't to screw up GC process under any circumstances.

I doubt there is any article as such, since, unlike many immigration matters, this has never been an area of confusion - an EAD allows you to work in any job. If you want some evidence then the use of an EAD for a second job is mentioned here: http://www.murthy.com/485faq.html#3. Of course, you need to ensure that your ongoing employment is acceptable for approval of your I485. If you are taking a second job or temporary work in addition to your main job then this is a non-issue. However, if you give up your main job altogether this is where you need to rely on AC21, and you would have to take a similar job in a similar field.
