Can I switch category EB-1 to EB-2 after filing.

I filed EB-1, and now I finally got my labour certification done.
Can I swich to the EB-2(NIW) withouth filing from the beginning?

Don't switch, send a separate petition. Does your company's attorney know you have a EB-1 filed? Most defenitely consult with them.


If you have an approved LC, don't do the NIW. The purpose of the NIW is to *waive* the need for an LC.

What do I need to check in the 1-140 application in the part that asks: Has any immigrant visa petition ever been filed by or on behalf of this person-No-Yes-Attach all the info.
