Can I switch Back to H1B from EAD

Gurus,

Myy EAD is expiring and Renewal is taking more than 1 year as per new processing times.

Can I switch back to H1-B. I am in EAD and I dont have any H1-B status now. I have used 5 1/2 years of h1B previously. Six years is not utilized

What are pros and cons..

Please help..
 
i think your employer will have to file a fresh H1B petition......you will not be counted in the quota....and he can request 3 years based on your approved I-140..

but i am not sure...you can work till your H1B is approved.....but if you go for premium processing.....you should get result in 25-35 days.

U want to use H1B because your EAD is expiring! Hee Hee!
Have you heard of Interim EAD?

If you filed for renewal and it's been more than 90 days...then you can get Interim EAD from local INS office...
You can also get AP if you have genuine emergency...by visiting INS office..

If you want to get back to H1B...you can get your new H1B...but you need to get an I94 card as proof of status...which one can do by going overseas and get it restamped...and get an I94 card...
 
Anyways, the EAD processing times have been corrected...they are back to 3 months processing time now...

I believe, only the national customer service centers can issue interim EAD's....So, one has to go to the local office and request for Interim EAD....and the request would be dispatched from the local INS office to the national customer service and that's how one gets Interim EAD?

It takes about 90 days. Stop calling/listening to the USCIS misinformation hotline!!! They have no idea what they are talking about, especially when asking about processing times, they always over exaggerate!!

Also they don't give out interim EADs any more, if its been more than 90 days, you make an Infopass at Philly DO, and they put a request into NBC to expedite your EAD or mail you an interim one. The days of walking into the DO and walking out with an interim card are sadly gone.
