Dear forum members I need your help.
This is my problem. I am currently in a situation where I have to go in front of a judge every three months to give her an update on the status of my I-140's progress. I was also imprisoned for a little while because I was out of status.
How did I fall out of status? This is the time line.
September 1999 I request for H-1 visa from Mr. Nubani & Associates
February 2000 my Optional Practical Training card expires.
March 2000 I pay the fee for H1 along with retainer agreement fees (D).
December of 2000 Nubani and Associates submits my Application for H1 to INS (D)
April 2001 after calling Nubani & Associates I am sent the reciept of H1 Application Approval from INS where it says "This is FORM is NOT a visa" and I am asked to go to Islamabad to pick up my H1. Mr. Nubani tells me that I am now out of status and that I must indeed go to Pakistan BUT that if I filed for my green card I would not have to go to Pakistan. Avoiding the extra expense and the uncertainty of going to Pakistan I say "File for the Greencard".
April 2001 right before the April 30th deadline the greencard is filed.
January of 2003 the registration process begins and Nubani & Associates tell me to call them in case I am jailed because I am indeed still out of status.
February of 2003 registration goes well.
February of 2003 the request for labor certification approval is denied , Nubani & Associates ask me to write my own rebuttal.
February of 2003 I hire Weinrib & Associates law firm to write my rebuttal.
February of 2003 my H-1 approval notice expires.
March of 2003 I am jailed for being out of status. Released in a week on bond.
April of 2003 I officially change law firms to Weinrib & Associates.
May of 2003 Weinrib and Associates win my labor certification and file for my I-140 (stage two) without filing for my I 485 simultaneously (they recommended against it).
July of 2003 my first court appearance after my arrest.
Since then I have been going to court every three months (with 3 court appearances uptil now).
I am expecting my I-140 to be approved anytime now.
The psychological toll and the emotional anguish I have suffered cannot be expressed in civilized words.
I have documented evidence for all my transactions with Nubani & Associates marked (D) in the timeline. I would like to take responsibility for not going to Pakistan to get my H1 (my reasons were grounded in my fear for my personal safety and I can provide evidence supporting this claim).
My interaction with Nubani on the whole has been unwholesome. He has been abusive on the phone and ignored my phonecalls.
At the least I would like to take out an Ad in the NY Times or the Chicago Tribune exposing this man.
My questions are :
- how do I sue him? Can I sue him? Can I do ANYTHING to him?
- More importantly, how do I get out of the mess I am in?
