My asylum case has reopen at the ninth circuit after they closed it due to ineffective representation. My previous lawyer her name is Sarah Jones ( her office is in SF) has neglected my case and lied to me after paying $7500 in service fee back on Jan 2009. One day I called to her office, she was not there anymore. Pretty shocking cause knowing she has been in practice for many years. My asylum case was actually closed on april 2009 and I did not know it till May this year. In the time getting my case reopen I have DHS agent looking for me at my work place. Luckily I was not working at that time. So I had to hide for 3 months, and in that times I was getting a new lawyer and got my case reopen. I have a wife and a newborn baby, the baby was 5 months old. Finally the case was reopen at the ninth circuit on last August. I am still worried that agents still can detained me but I still have to work to support my wife and son.
After reading the tread from this forum I notice that I meet the requirement for COR. I have been in the US continously since 1996, good moral with no criminal record and extremely hardship to my wife and son if I leave. My wife is not LPR but my son was born here in the US.
My question is if my asylum get denied, can I apply for COR or can I apply COR while the asylum case is pending at the ninth circuit.
