Can i return without AP

Friends, I am going to India next week. But the problem is I have not received my AP. I tried and persuaded my lawyers to get in touch with INS and find out why it is delayed. I am currently on H4 visa and filed my I-485 in December'01. Can I comeback on H4 visa in case I don't receive my AP. Please suggest any alternatives. Thanks
 
A valid H4 is absolutely fine, I just got back in H1 with AOS pending and that was intentional. Make sure you carry your receipt notice from INS for I-485 if available at this point.

If you really want to use AP, try local INS office and you may get lucky
