My H1b visa stamp has expired. I now have an H1b extension until 12/2006.
I would like to go to Canada to get a visa stamp but I am concerned it may
be turned down. (No real grounds for this feeling; just the usual paranoia.)
Just in case, I have applied for Advance Parole (pending I-485 under
EB2/NIW), but reading some of the posts on this and other sites I get the
impression that if your visa is denied at a US Consulate in Canada or Mexico,
you CANNOT reenter the US on AP. In which case I would be forced to go to
India.
Is this true? Can someone please clarify the rules on this?
(Apparently, this only applies to Canada and Mexico.)
Also, does USCIS hold you to the reason you give for applying for AP?
