Can I qualify for L1 visa

I was working in India for 3 years in company A, then I resigned and came to US on dec 2002 to do MS , I completed my MS on may 2004 and got a job in company B,Iam on my OPT now, Can this company B apply for my L visa.
They missed the HIthis year so they want to retain me under any circumstance.
Will I qualify for L visa,Does this visa fall under any cap,

Is there any way for maintaining my status after my OPT expires on June 2005 :confused:

Unless there is a relationship between company A and company B (such as B is a subsidiary of A), you can apply for an L1 visa. However if no such relationship exist you will not be able to apply for L1. One of the requirements of the L1 visa is that you have been employed for one year or more with the petitioning company abroad.

Check with an attorney to see if there are other alternatives.
