Can I put stop payment on I-485 fee(my personal check)?

Please see the details of my particular case and let me know if CP is still an option, and is it legal?

My I-140 approved for CP on December 2001 at INS-NSC. NVC didn’t receive my petition till 19th April 2002. On April 19th 2002 my employer ask me to go India and work from India office for six months or work for 20 hours a week which is possible on EAD/Green Card. Since 120 days my I-140 is not moving from INS-NSC, I thought I could file I-485 immediately and get EAD in 30-90 days. I requested my employer same thing he agreed and filed for I-485 on April 19th 2002. On April 22nd 2002 NVC received my I-140 form INS-NSC and also NVC created my case. INS-NSC didn’t cash the check as of today (May 7th 2002).

1. Can I continue with CP? If so what will happen to my I-485?
2. Can I put stop payment on INS fee check? If so is there any future problems with INS? Is it advisable?

are you worried about the 485 fee and CP fee?

Then I don\'t have answer for that.

Otherwise, if you are worried about the 485 being processed when NVC processes your CP, then you need not worry. INS will take months to assign the case to officer, then he finds out the file is missing and sends cable to request the file. I think by that time your CP will be completed. In most cases this process (linking file from NVC or consulate with 485 petition caused lot of delays for nuber of persons and finally they had to file I-824 to get the file back to INS, their case is different they wanted to continue with AOS than CP). This delay might be to your advantage.

You can continue with CP, but given your unstable state right now, maybe 485 (EAD + AC21 protection) would be the wiser choice.
 
It is either 485 or CP, IMO....

When you do for CP, they are sure to find out about EAD, AP.
Questions are very likely to cpme up.

I\'d check this with attorney. I am not an expert.

On the other hand if you want to go for I485, that\'s the easy part,
just dont send your Pkt3 (which you receive from NVC) back to NVC.
