I have assylum granted August 2001, and applyed for green card August 2005. My girlfriend is illigal immigrant with long process in court. Could I make her gain same status as me if I marry her???And if I can what document do I need?? Thanks a lot...

too late

too late you wasted too much of time, between 2 years was the requirement....

when you get your GREEN CARD then apply for her but it looks like that will happen in 2015.. looks like your girlfriend needs to look for another open window..

Do you mean that if I get married within 2 years after getting asylee status my spouse will be eligible to obtain derivative asylee status? A couple of months ago I asked this question on this forum and the answer was NO.

The answer is the same - NO. U have to be married before getting ur asylum status and your spouse and kids under 21 and unmarried can be included in application. What happens after INS don't care. In ur case ur girlfriend only can legalize after u'll become citizen which probably will be in 15 years (according to USCIS proccessing time schedule). Sorry. Try to win GC for her and for urself by playing GC lottery every year. Good luck.

yes and no

check this out can you back date the marriage certificate or something?

Will I Be Able To Petition To Bring My Family To The United States?
If you are granted asylum, you may request derivative asylum status for any spouse or child (unmarried and under 21 years of age as of the date you filed the asylum application was pending on or after August 6, 2002) who was not included in your asylum claim and with whom you have a qualifying relationship. You must submit a Form I-730, Refugee and Asylee Relative Petition, to the Nebraska Service Center, P.O. Box 87730, Lincoln, NE 68501-7730. The Form I-730 must be filed for each qualifying family member within 2 years of the date you were granted asylum status, unless USCIS determines that this time period should be extended for humanitarian reasons. See How Do I Get My Spouse or Children Derivative Asylum Status in the United States?

or go to this link http://uscis.gov/graphics/howdoi/asylum_spouse.htm

she qualifies if you apply for a waiver to unblock the 2years limitation using humanitarian purpose..

My friend has the same problem, he's got asylum status and now he wants to marry his girlfriend, but it's useless statuswise for her.... IS THERE ANY WAY TO ADJUST HER STATUS (she doesn't have one now)????
