Hi, everybody:
I concurrently filed I-140 (EB-1B: outstanding researcher with the
employer sponsor)and I-485 petitions in July 2004, and my I-140 was
approved last year. Since I will change the job in a relative different
research field, I intend to file another I-140 petition based on NIW.
My questions are:
1) If the second I-140 is approved in the near future, can I link my
original I-485 (the priority date July 2004) with this new I-140
petition?
2) If the second gets denied, is any negative effect on the previous
petition?
3) Is any conflict or concern between my two different I-140 petitions,
since one clamied I have a permenant offer, and the other claims I need
to waive the PERM?
