Hello Guys,

I need some seniors valuable advise on my situation :(

I applied my 140 and 485 simultaneously two months back. The client wherever I am working asking me to come as an employee. Because they can't keep me further down. I do also interested to join as an employee. My question is with the EAD and without completing 6 months after filing 485, Can I join a different employer. Is there is going to be a problem or it won't be a problem.

Appreciate all you guys replys

you cannot unless your i140 is approved and 180 days have passed filing I485..
you will have to start fresh with your GC if you change employer before the above condition is met...

Damn right...You have to wait for I-140 to be approved...If you switch employer before I-140 is approved ...the employer might withdraw your I-140 and that leaves u nowhere...

why would the employer want to withdraw the I-140 petition, especially if I-485 has already been filed for 6 months?

hey..i may be in a similar position.... My understanding is its safe to change employers once I-140 is approved but however if your previous employer does not withdraw his I-140 and agrees to support any rfe's then there is no problem to change jobs..remember the gc is for future employment..
this is my opinion...thanks

Reason for withdrawal

On the other hand if you are not going to work for that Employer he will want to with draw the I140 application and use the labor that was approved on behalf of you for somebody else.

can the employer re-use the labor even if 140 and 485 have already been filed for an employee using that particular labor?

I guess yes

If I40 is pending, then he can withdraw that petition that means 485 becomes invalid and the labor is then unused, which can be reused....
