Can i initiate inquiry with the lawyer

I must be one of the unlucky oct 03 filer. still waiting for I-140. Do u guys know if i could initiate inquiry with the lawyer. If so, does the USCIS penalize me??? Please let me know
 
Wont help but doesn't hurt.

I dont think it will be of any use but still you can try if your lawyer accepts since the posted dates for I-140 are Sep 15 2003 for EB2 they will not entertain any inquiries.
