Can I go for CP interview, If I have I485 Adj. in process. Please respond.

Hello All.
I got two I140(Employment based) one in EB3 for CP and another one in EB2 for Adjustment status approval using one Labour(same position).

I got I140 EB2 Adjustment first and applied for I485 and finished my FP also. But my another I140 in EB3(CP) for the same postion as it is in the Labour
is already gone to Consulate and I didn\'t sent Packet 3 for consulate(CP) interview.

Here my question is whether any problem for I485 approval here or not in this situation, Can I go for CP interview after I send Packet 3.

Is it any way INS can findout that the same Alien got two I140 while processing I485 ?

INS regulation do not allow parallel AOS/CP. However, it is NOT ILLEGAL!!!

Since your case is at the consulate, it is out of INS hands, so if you get PR this way, it will be probably legal.
Problems may arise after both AOS and CP process will be complete. You may need to withdraw your AOS application if you get PR status via CP or vice versa.

This is my (non-professional) opinion, please ask a lawyer for his.
 
Yes you can.

I got my GC through CP using the AC-140 process while my I-485 was being processed.

Which consulate did you go? Did you submit I-824 reciept ? It seems like chennai doesn\'t require it?
