Can I get Student visa?

My six years on H1 are already over. Currently I am in my 7th yr on EAD. I filed for I-140 and I-485 on Feb10,2003. I used an approved labor for some one else for my filing.

I have received some inquiries from INS regarding my experience. If for any reason my I-140 app. gets rejected can I appply for a student visa?

I am a part-time student currently and would just HATE to loose my education.

highly impossible.

once anyone files immigrant petition on your behalf then you will not be able to get student or visitor visa as you have showed your intend to immigrate into usa.

even if f1 is approved you will not get i94 attached. then you have to go out of usa and get f1 stamp and then re-enter. as you have showed your immigration intend by filing i140 and i485 most likely consular office might reject your visa.

work with some good lawyer and act based on that.
