In brief the situation I am in is -
1. I filed my EB3 RIR labor in Jan 2004. It went to backlog center.
2. I filed my EB2 PERM labor in Sept. 2005. I got it approved. Then I applied i-140 and got it approved in Dec 2005.
3. Since the Visa dates for Indian's became unavailable for sometime in 2006, I changed my employer in 2006.
4. I have copy of my PERM labor, copy of 140 approved (with PD as Sept 2005), and ETA case number of first RIR labor.
5. I checked the satus of RIR labor online using ETA number, and its been certified, ie approved.
Now that I have changed my employer, I was wondering, is there a way for me to get the old priority date on my 140 (date of RIR labor ie Jan 2004 ) instead of date at which I filed PERM.
This way, I will get earlier date, when I will file 140 with new employer.
Since I have already changed a job, there is no way for me to go back to my old employer and ask to file 140 for RIR labor and then transfer the date.
Any responses appreciated.
