I came here as a permanent resident thru marriage, 10 yrs ago..My marrige was annul by my wife, before i can apply for citizenship. My green card was renew twice and the third time they took it and said i would hear from them, i wrote to them and went up to them many times for an answer, but didn't get any ...Recently i contacted my congressman who intervene and they said my case is close...My mother who is a citizen here wants to apply for me..I just want to know since i am already here, do i have to file the I-485, together with the I-130...or just file the I-130 alone, i am confuse...Please help....

If you are already a permanent resident, why are you expecting your citizen mother to file for you? Did they revoke your green card? What is going on? Was your marriage annulled before you filed for the unconditional 10-year card?

RE: filing I-130 I-485 together

Thank you for your reply....My marriage was annul before the unconditional 10yrs green card..However that case is close, they told me i can have my mother sponsor me, so i just want to know, since i am already here if i have to file both I-485 and I-130...

It was annulled before the first 10 year card, but then they still renewed the card twice? So you have been a permanent resident for more than 20 years now?

Unless they took you to court to revoke your card, I think you are still a permanent resident. After you've been a PR for 5 years, they can't rescind the card administratively.

You need a good lawyer to sort out this madness. Even if your mother sponsors you, you can't stay in the US to wait for the green card because you are over 21.
