Can I file I485 to make it concurrent if parents come to US after I130 has'n filed?

Hi, All,

I have been waiting on I130 approval for my parents for over a year now. I am US citizen and my parents are in China right now. If they come to US on B2 visa next month, can I submit the I485 so it will be concurrent filing? Does that mean they will be able to stay in US and wait for the approval of both I130 and I485?

By the way, who knows how long do people get to stay in US on B2 visa now? I have heard that it ranges from a few weeks to 6 month. Can vistor on B2 extend their visa after I94 expires?

They will logically be not allowed to visit US while their I-130 is being processed. They will be stopped at Port of Entry..

Hi, Swaiting,

I wonder if the INS don't have my parent's record in computer yet since they have not process their case. I have so far only received the receipt notice after I send I130.

Also this time I am hoping my parents can bring both my kids to me from China. Would they consider this as a special case? I left my kids with my parents this January.

For Visa appliaction form DS156,there is question to be answered
by the visa applicant.Q no. 36.
Has any one ever filed immigration visa petition on your behalf.?
If you have filed I130 for them,they need to answer:Yes.
This will tell the visa officer the story and it is hard to convince the visa officer about the non-immigrant intent of the applicant for visitor visa..(generally they will not).
