Hi
I am a UK citizen and filed I-140 (NIW) in March 2007. I was planning on filing I-485 before the end of July. However, I am confused about the new I-485 ruling. Are they accepting ANY I-485's right now? One page on the USCIS web site suggests that you can still file if your priority date is currrent. Another page says no employment based applications being accepted at all. Are any priority dates current? I am not sure if mine is. I tried calling them to find out but they just directed me to the website.
Any help appreciated.
Thanks, 10.

One can file I-485 if the PD is current. However the recent Revised Visa Bulletin published by DOS on June 02, 2007 says there are no more visas available for EB categories until the end of this fiscal year, 30th sept. That means NO ONE can file I-485 until the end of September 30, 2007 under EB categories.

I think you will be eligible to file I-485 on 1st October when the PD dates become current provided its current for UK (mostly its current for UK). Look for VISA BULLETIN published in MID SEPTEMBER.

Hope this helps
