Can I file I-140 in premium with sub labour

Hi,

My company is ready to give me one sub labour to file I-140. Could anybody tell me that is it possible to file I-140 in premium when using substitue labour.

I guess he wants to file under premium processing as he's like to get the 140 approved ASAP so that he can keep the PD listed on the labor.

Yes, you should be able to file it under premium processing as there is nothing that explicitly prohibits premium processing for a labor sub case.

U mean to say if he does not do premium .. then he will not have keep the PD listed on labor .. ... Hmmm .. thats news to me then.

I just meant to say that the original poster wants to get it over with ASAP rather than wait.

The local grapevine has it that the USCIS will not encourage substitutions any more. These canards have been circulating for months and no one knows when this policy will actually go into effect. I think most people are rushing to take advantage of this status quo before it's cancelled.

Just to clarify, whether you file under premium processing or regular, once the 140 is approved, you'll be allowed to keep the PD on the labor.
