Can i file I-140 Based on May/2007 approval date

My own labor was approved in first week for May/2007.
Can i file I-140 Based on May/2007 approval date ?

Some people say, after July/17 you are allowed a 45 day gap between labor approval and I-140 filing . Is it applicable to NON-PERM cases as well ?

That rule does not applies to pre july PERM cases, you could have filed I-140/485/875/131 when visa dates were current in July 2007, nevertheless, you can file I-140 now, BTW it is not 45 but 180 days
