Can I file for two labors??

Hello,

Can I have two labors filed simultaneously -- one by my current company and another from a prospective future employer. If so, any implications of doing this???

Thanks,

Good for you. There are many people who have the reverse problem.

No, one LC doesn't affect the other (just be sure to put a consistent experience history on part B. You don't want them to hold discrepant filings under your nose.)

You can also have more than one I140 pending, in case you are not so sure about one of the companies ability to pay.

You can have multiple LC petition pending/approved at any given time. There is no restriction from USCIS or DOL.

Can there be 2 simultaneous applications for the same person (with the same employer) in Non-RIR as well as RIR categories? I read somewhere that there can be multiple DOL applcations at the same time but only when they are all with different employers. Is it true?

Where can I get more information on this?

Yes. But they should be for different position.

Thanks for such a quick reply.

My Non-RIR case is filed for 'Software Engineer' position. Can I file a RIR case in parellel to this case if it's for a different position, say 'Sr. Software Engineer'? Or a different minimum wage category will work?

You can certainly try but if I were certifying officer and find out about "Software Engineer." and "Sr. Software Engineer", I will definitely ask employer to withdraw one.
