Can I file for DV lottery while I-140 apeal pending

Hi can I file for Diversity visa lottery since I am in US, have pending H1B process and I-140 apeal process. Thanks

Are you asking whether or not you can enter the DV2010 lottery? If thats your question then the answer is YES. Go ahead and submit your application, you have nothing to loose.

If there are other issues surrounding your initial I-140 denial then you will deal with those when you are selected. :)

Meanwhile, don't let the H-1B or I-140 issues spin out of control because they can come back to bite you in the future.
