I wish to know if this issue is still unclear and need to wait for the AC21 guidlines, or it is clearly stated in the law. It sounds to me make no sense to restrict job change after GC since nowadays people can even change job before GC. Please comment and give some links/references. I want to change job the next day after I hear approval from on-line.

Thanks.

From the other threads that I have read before....

It is not recommended to change UR job for 6 months( except if they lay U off)

Also, it is always better to change using AC21...

I am sure, some other members can throw more light on this issue.

it is totally dependent

on your company and how much riisk you would like to take.

Please refer Immigration-law.com---an article published about 6 months ago talked about this specific issue in details.

AC21 might not apply for your job change after your GC approval, and, one guy on this board got his GC approved and subsequently changed job, and, guess what-- the company got his GC withdrawn by simply writing INS. However, many lawyers say you can change your job after GC. Their explanation is: you can change even after 180 days of 485 receipt, then why not after GC. I personally had an opportunity to raise this question to a very professional immigration lawyer in a big conference, whose answer is positive--you can.

Again it is your decision to make.

how is your rapport with current company

If you are laid off then you can change without any problem. If you are changing on your own then you must leave in good terms.Once your case has been approved you can work for anyone but if the current company makes a complaint to INS then you may be in trouble. In such cases it is advisable to wait for 6-7 months.

One more question.

If the sponsoring company does not provide you insurance when you do not have a project.. does it lay a perfect ground to quit the company ? Becoz, if the company hired you full time and permanent, they have to pay the insurance as long as you are on the rolls right ? Can anyone answer this for me. Thanks in advance.

Waht about the consequences downstream, like in naturization in 5 years? Any problems if changing job next day after GC approval?

Thanks, folks.

see I am not sure what could be the legitimate ground but the best thing would be to talk to employer. You can say him that you need insurance and all, may be he will let you go wiilingly. It would be advisable to leave in good terms and nothing will happen till he makes complaint.

As long as the consequences in long term is concerned, if you have survived for 5 years after GC, the only thing which would bother your citizenship case would be your background check. If you have been loyal to land of law you will get it.......There is no long term consequences for it .

gwpeng.

After 5 Years - you have to prove that you did not do any fraud by expressing false intension. But, if the sponsoring employer does not provide insurance when you are "ON BENCH", I consider that the company is taking advantage of me - By earning on me when they can and leaving me alone when I am not productive. So, when you are subject to such condition, I THINK we can prove that our only option is to get a "REAL" permanant job. I am awaiting views from the forum though.. as I am not that much enlightened in these matters.
