Can i change from EB3 to EB2 ? After receiving PERM/Labor in EB3 Category ?

Hi All,

I applied for Labor/PERM in EB3 category. unknowingly I have applied in EB3 category instead of EB2, but am eligible for EB2 category ( my qualification is Graduation in Bachelors of Commerce (B,Com 3 years) and Masters MBA(2 yrs) from India.
Note: I received PERM (labor) in EB3 category recently.
I have 5 yrs of work Experience after MBA (Masters)

My few questions are:

1) AM I eligible for EB2?
2) Can I change my category from EB3 to EB2?
3) At what stage I can change category from EB3 to EB2 (for e.g.: 140 or 485 level?)
4) What is the eligibility for applying in EB2 and EB3 category?

Can anyone help me on this?

Labor Certification/PERM is applied by your employer, not you. EB3/EB2 classification is based on the minimum requirements for the job they are hiring you for. You and your qualifications come into the picture when you file I-140 and at that time you will have to show that you meet the minimum requirements of the job.
