My current status is:
Priority Date: Dec 2003
CP Status: Submitted the DS 230 form on 17th Jan 2005
Category: EB-3
H1-B remaining Period: only 6 months (Expires in Sep)
With the retro in effect I am completely screwed, I have to wait for god knows how long for my interview date. I think it would be definitely more than 6 months. Hence I am looking at different options:
1) After my 6 months on H1 can I go back to India and still expect a call for my GC interview. If so would that be safe to do or should I go for extensions on my H1 untill the date of interview.
2) Can I change Employers after submitting DS 230 through my current employer and still keep the case valid and go for the interview whenever possible. Then apply for a fresh GC through new employer on PERM.
I need your help in sorting my case.
