Can I Change AOS to CP?

Is it possible to continue with CP in my Case?
My I-140 approved for CP & NVC created P3 on 2nd week of May 2002.
I filed 485 on April 2002. My employer is asking me to go to India and work from there till you get your Green card. What are all the options to go with CP in my case? Please suggest me on this.

I believe you can proceed with CP

You can proceed with CP if you file for a withdrawal of your AOS application.

But, if your lawyer advises on 824, please make sure your consulate is not Chennai.

I got my P3 today, gurus please help me.

You are already on track for CP....

Since you got P3, means your I-140 was approved for CP not AOS. Check approval notice thoroughly.

I-140 approved for CP but NVC didn\'t receive my file more than 120 days then we filed I-485 just 20 days back.
 
I think you better proceed with CP

I am not sure you need to request INS not to process I-485, one thing I can tell is if you get ant EAD\'s then make sure you don\'t use them.

More over, your file already is with NVC, you received P3, then you will get interview within 3 to 4 months at the most. I do not see any chance that INS will request for your file back within this period of time, even if they requested it will take a while for NVC to reply to INS to contact respective consulate for file (file needed for INS to link with your 485 petition). Either way you are on safe side if you act now.
