Can I apply two I-140 from the same employer

Hi Gurus,
I have a pending I-140 (Eb2) with PD of 2005, I applied this in Jan 2007.
My company has a approved EB3 labor with PD of 2003. I am trying to apply EB3 I-140 in premium to get the earlier PD. Can somebody please answer following questions
1) can I have/apply two I-140's from same employer
2) Does this effect my pending I-140 if I applied for two I-140.

I am also in almost same situation here. Someone please clarify.

I got I-140 using EB3-India PD 1 Oct 2001. Now my company would like to apply for second I-140
using pre-approved EB2-LC-China (PD April 2004) and port my EB3-India PD (1 Oct 2001).

My company lawyer says it is doable with proper documentation but we have to do it quickly before
LC substitution goes away. More over, we can't use premium I-140 processing in this case, it seems.

Note that my second I-140 will be 'Labor Substitution + PD porting'. Is it OK to apply second I-140 from the same company like this?
