Hi

My i-485 is pending with SFO Service center for an interview. I recently got married and wanted to know if it is too late to apply for her as a dependent so that we might both get our GC around the same time?

thank you

You can apply for your spouse as a derivative, but doubt you can get her approval at the same time as yours. That is too much to ask for. I suggest you move really fast because the moment your case is adjudicated you can only sponsor your wife by filing a FTJ motion which takes 3-5 years.

Do you suggest applying for her as a derivative is something i can do myself or do you advise getting a lawyer?

And, do you know where i can learn more about this?

thanks

Better add her before interview. Go to interview only after you applied her I-485. If required, postpone your interview. There is a good chance that you will be approved on the spot after interview, or may be few days later.
Once you are approved you cannot add her for I-485. She will wait for years in follow-to-join process.

Most probably she won't be approved with you, unless your I-485 process get delayed significantly. But things are getting better. Hopefully she won't have wait that long.

Yes, you can apply your own (lots of people do and derivatives case is lot simple). Unless you know what you are doing, probably you have to spend (read "waste") some time to do some homework before applying. And I am not sure if you have that kind of luxary in this situation. I would recommand to hire an attorney. Lots of lawyers are are busy with too many cases. They can delay to apply. Find someone who can do your job quick.

Apply ASAP no matter what method you choose. Else you will be doomed to spend the first few years of married life seperated from your spouse or outside the country. (Unless she has a valid visa on her own right).

There are website that offer you all the forms in a package that you have to fill out. Don't have the link on me, but it is easy to find. If you go through a lawyer, make sure you get them to MOVE FAST! You are too close to approval to mess around.

Thanks.. Please let me know if you find the site. I really want to do my research before talking to a lawyer.
