can i apply for new H1

hello,

i am currently in f1 - o.p.t period (till feb'05). I got my h1 approved from company A (employed since feb'04) starting from oct 1st.

i have a better job offer from company B-which if i accept i should start from sep 1st.

Should i apply for a new h1 or a transfer of h1 on oct 1st (i would not be working in company A from sep 1-sep 30)

if i apply for new h1-i will come under quota- r visas available under quota?

pls kindly reply ur opinions quickly

Since you have not started working on H1 there is no question of transfer H1 your status is still F1-opt so inorder to work for company B you have to file for New H1 .BUT again your new H1 whenever its approved will be vaild for next financial year i.e valid from OCT 1 2004 onwards .

I have no idea of R visa ....
