Can I apply for I-485 - Please Guide Me!

Gurus,

My company substituted an approved labor (EB3) with a PD 03/01/02 and filed I-140. The I-140 got approved on 09/19/2005.

Now my question is, Will I be able to apply for I-485 before the Visa Retrogression takes place by 10/01/2005 ?

Did you say EB3? If you from India/China? You are big time royally screwed!
No offence meant as I am in same boat.
To answer your question, NO EB3 VISA numbers are available
since July 2005 and so you canNOT file nothing for another
3-4 years.

Sorry but the comment above is exactly right. The visa numbers for EB-3 right now are unavailable. Have been since July. That means you CAN NOT file I-485 period. Thats why so many people are so upset. They have been waiting for months to see what the new fiscal year would bring for visa numbers. Obviously nothing good. It is worse now then it was before July. The visa numbers have retrogressed to 1998. Until your priority date is reached you can't file I-485.
 
Thanks. I'm surprised that my Company attorney got all the forms (I-485) signed for my family and myself and said that they would file before this month. I don't know if it could be done. But it is from the attorney, I believe there could be somthing that can be done.

Funny!

May be he got the papers from you before the disasterous October dates came out. If he got it after Sept 18th, Either your attorney is too smart or totally dum.
Too smart meaning trying to get some extra $ by double filing.
If not pass it on to him and he needs to look at this site for why we cannot file 485 for next few years... Don't keep false hopes.
