Hello,
Current H1B 6 years completion : March 31, 2013
Labor Priority date: Oct 15, 2012
RFE Date Jan 10, 2013
New PERM Labor Priority date Jan 12, 2013
Question: If labor applications are pending approval and lawyer applies H1B transfer on March 25, 2013 in normal processing, asking 3 years extension, can I stay beyond March 31, 2013 .. legally?
Legally in the sense.. with an H1B receipt number (initial review), and by the time they send RFE and lawyer replies, we will hopefully have labor approved and I-140 approved too.
