can i apply for AOS during I-824 processing ?

hi all

i submitted an I-824 for a CP after my 140 approval (EB1 category) because i heard it was faster than AOS. but 5 months later, no developments ! do you know if i can file for AOS now while the I-824 is still alive, or can i cancel the I-824 ? what do I do now ?

Yes you can apply for AOS here. The I-824 will be deemed as abandoned.

But you can also use faster method of Attorney certified 140. But your Consulates should be accepting that kind of request. If they accepts that you do not need to wait for I-824 approval but request the Consulate do your interview because of delays and other problems you are facing here.
